Privacy Policy

1. Introduction

Pinnacle Real Estate is committed to protecting the privacy, confidentiality and security of personal information entrusted to us. This Privacy Policy describes how we collect, use, process, disclose, retain and safeguard personal information in connection with our real estate advisory services and our proprietary software platform, Pinnacle Edge (the "Platform"), including when individuals visit our websites or interact with us electronically.

Pinnacle operates from Toronto, Ontario, Canada. We process personal information in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act and other applicable provincial, federal or international legislation.

If you are a client of Pinnacle and have entered into a separate written agreement with us, the terms of that agreement will govern to the extent of any inconsistency with this Privacy Policy.

2. Scope and Roles

In operating the Platform, Pinnacle generally acts as a service provider processing Client Content on behalf of its clients in accordance with their instructions. In relation to our own business operations, including marketing, billing, analytics, compliance and service improvement, Pinnacle acts as a business determining the purposes and means of processing personal information.

3. Personal Information We Collect

We may collect personal information necessary to operate our services and Platform, including identifying and contact information such as name, business title, company affiliation, email address, telephone number and business address. We may collect account credentials and authentication information required to access the Platform.

In connection with subscription and billing, we may collect payment and transactional information necessary to administer accounts.

Users of the Platform may upload or input lease agreements, financial models, investment analyses, transactional documents and related materials ("Client Content"). Such materials may contain business information and, in some cases, personal information relating to third parties.

When individuals visit our websites or access the Platform, we may automatically collect technical information such as IP address, device type, browser type, access times, session activity and usage patterns.

We do not intentionally collect sensitive personal information unless required for legitimate contractual or legal purposes.

4. Sources of Information

Personal information is typically collected directly from clients, authorized users or website visitors. We may also receive information from payment processors, analytics providers, advertising platforms or other service providers acting on our behalf.

If a user provides personal information relating to a third party, the user represents that they have obtained all necessary rights and consents to disclose that information to Pinnacle for the purposes described in this Policy.

5. Purposes of Processing

We process personal information for purposes that are reasonable and necessary in the context of our business operations. These purposes include providing advisory services, operating and maintaining the Platform, administering user accounts, authenticating access, processing payments, providing technical support, communicating service updates, improving platform functionality, preventing fraud or misuse, maintaining records and complying with legal obligations.

We may also process personal information where necessary to establish, exercise or defend legal claims or to protect the rights, property or security of Pinnacle and its stakeholders.

6. Artificial Intelligence and Automated Processing

Pinnacle Edge may incorporate artificial intelligence and machine learning technologies to assist users in analyzing lease agreements, extracting contractual provisions, structuring financial assumptions and enhancing workflow efficiency. These tools are designed to support users and do not replace independent professional judgment.

Client Content is processed in order to provide the requested services, including document parsing and structured data extraction. Pinnacle does not sell Client Content and does not disclose identifiable lease language or proprietary documents to other users.

To improve the accuracy and performance of the Platform, Pinnacle may use anonymized, aggregated or de-identified structured data derived from Client Content for system training and optimization. Such information is processed in a manner that does not reasonably identify a specific client or disclose proprietary transaction details. Pinnacle does not use identifiable lease documents or confidential materials to train generalized models across customers without appropriate authorization.

AI generated outputs are assistive in nature. Clients remain responsible for reviewing and verifying all extracted data and analytical outputs prior to reliance.

7. Third Party Service Providers and AI Vendors

Pinnacle engages third party service providers to support its operations, including cloud hosting providers, payment processors, analytics providers, advertising platforms and artificial intelligence technology providers. These service providers may process personal information on our behalf and are contractually required to use such information only for authorized purposes and to implement appropriate safeguards.

Where artificial intelligence services are provided by third party vendors, Pinnacle configures such services to limit retention of Client Content where commercially feasible and consistent with service functionality.

8. Cross Border Transfers

Personal information may be stored or processed outside of Canada, including in the United States or other jurisdictions where our service providers operate. In such cases, personal information may be subject to foreign legal requirements. Pinnacle takes reasonable steps to ensure that appropriate contractual and technical safeguards are in place when personal information is transferred across borders.

9. Marketing, Analytics and Cookies

Our websites and Platform may use cookies and similar technologies to maintain session integrity, enhance user experience, analyze usage patterns and support advertising activities. We may use analytics providers and advertising platforms, including retargeting technologies, to understand engagement and promote our services.

Users may adjust their browser settings to refuse certain cookies; however, some features of the Platform may not function properly if cookies are disabled. Promotional communications include an unsubscribe mechanism. Operational or service related communications may still be sent where necessary.

10. Data Security

Pinnacle implements administrative, technical and organizational safeguards appropriate to the sensitivity of the information processed. Access to Client Content is role based and limited to authorized personnel who require access in connection with their responsibilities. While we take reasonable precautions to protect personal information, no system can guarantee absolute security.

11. Retention and Backup

Personal information is retained only as long as necessary to fulfill the purposes for which it was collected or as required by law. Backup copies of data may be retained for disaster recovery purposes for up to twelve months and are not actively processed except for restoration or security purposes. After applicable retention periods expire, personal information is securely deleted or irreversibly anonymized.

12. Data Breach Notification

Pinnacle maintains procedures to respond to security incidents. In the event of a breach of security safeguards involving personal information, we will assess the incident and provide notification to affected individuals or regulatory authorities as required by applicable law.

13. Age Restrictions

The Platform and our services are intended for business use. We do not knowingly solicit or collect personal information from individuals who have not reached the age of majority in their jurisdiction. If we become aware that personal information has been collected from a minor without appropriate authorization, we will take reasonable steps to delete such information.

14. Individual Rights

Subject to applicable law, individuals may request access to personal information held by Pinnacle, request correction of inaccurate information, withdraw consent where applicable or request deletion or restriction of certain processing activities. Requests may be subject to identity verification and legal or contractual limitations.

15. Corporate Transactions

In the event of a merger, acquisition, financing or other corporate transaction, personal information may be disclosed to prospective transaction parties and their advisors under appropriate confidentiality obligations. Pinnacle does not disclose confidential Client Content beyond what is reasonably necessary for transaction evaluation.

16. Changes to This Policy

Pinnacle reserves the right to amend this Privacy Policy from time to time. Updates will be posted on our website and will become effective upon publication.
